The Chandler Hall Project consisted of the construction of four multi-unit Manor Houses, a Meeting House, a Commons Building, and related sitework for a complex to be used for assisted-living in Newtown, PA.
During construction, the owner terminated the general contractor for failing to meet the project schedule. The owner sued the general contractor’s surety for the completion of the contract and for repair costs for what it saw as latent deficient work.
There were also several issues about the guarantied maximum price contract (GMP) and how it was administered.
TRAUNER was hired by the surety to analyze the administration of the GMP contract and how it was administered regarding owner related changes. We were also asked to identify changes to the contract that were made as a result of changes to drawings or verbal direction by the architect.
We provided order-of-magnitude estimates for the changes that were identified. TRAUNER also evaluated the payments made to the contractor within and outside the GMP contract.
TRAUNER provided a presentation that outlined its expert opinion regarding the surety’s position during mediation.
